These Terms of Service are the agreement between you and PICKME covering your use of pickme.nz and everything on it (the “site”).

You accept them by using the site in any way at all — browsing, searching, registering, publishing a listing, buying a paid feature, or contacting an advertiser. If you are not willing to accept them, the answer is simply not to use the site.

Version in force from 14 October 2026.

1. What this site is

PICKME is an advertising directory. People and agencies pay us, or are given space, to publish advertisements about themselves. We supply the space and the software. That is the entire business.

To be unambiguous about it, we are not:

  • an escort agency, a brothel, or a booking service;
  • an agent, manager, employer or representative of anyone advertising here;
  • a broker or intermediary, and not a party to any arrangement you make with anybody;
  • a participant in any money that changes hands between an advertiser and anyone else — we earn from advertising and paid features sold to advertisers, nothing else.

We do not relay messages between visitors and advertisers, and we hold no contact details beyond those an advertiser chooses to display. If you want to reach an advertiser, use the details in their listing.

Whatever you arrange, you arrange directly with the advertiser. Your judgement about who you deal with is yours to exercise.

2. Adults only

This site is for adults. You must be 18 or over to browse it, hold an account, publish a listing or contact an advertiser.

If you are under 18, leave now and do not give us any personal information.

Commercial sexual services involving a person under 18 are a serious criminal offence in New Zealand. Our position is zero tolerance: content that involves, depicts, refers to or sexualises a minor comes down immediately, the account is terminated permanently, and we report it to the New Zealand Police.

3. Words used in these terms

Listing — an advertisement or profile published on the site.

Advertiser — anyone who submits a listing, whether for themselves or for somebody else.

Content — everything submitted to the site: text, photographs, video, audio, links, categories, rates.

4. Your account

Some parts of the site need an account. When you register you confirm you are 18 or over and legally able to enter a contract, and you agree to give accurate information and keep it current.

Do not open an account for somebody else, do not impersonate anyone, and do not open one on behalf of a person under 18.

You are responsible for everything done through your account, so keep your login details to yourself. If you think someone else has got in, tell us at [email protected] promptly. We may suspend an account we reasonably believe has been compromised. Accounts cannot be sold, transferred or shared.

5. Publishing a listing

Listings are accepted subject to these terms and to any additional requirements we publish on the site. Every listing must:

  • be about a real, identifiable adult who is 18 or over and who has agreed to be advertised;
  • be accurate, and not false, deceptive or misleading in any respect;
  • use photographs of the advertised person only, taken or supplied with their consent;
  • comply with New Zealand law;
  • contain nothing that would be objectionable under the Films, Videos, and Publications Classification Act 1993;
  • not promote or facilitate anything unlawful;
  • comply with any relevant local authority bylaw, including bylaws made under the Prostitution Reform Act 2003 about where brothels may operate and how commercial sexual services may be advertised.

We may set limits on how many listings you may hold and on their size, format, placement and duration, and we may decline or remove advertising under section 7.

6. What must not appear here

You must not post, and must not let anyone else post through you:

  • anything involving, depicting, referring to or sexualising a person under 18;
  • anything false or misleading — invented identities, other people’s photographs, claims about services, rates or availability that are not true;
  • threats, abuse, harassment, hatred, or material that defames or incites violence against any person or group;
  • intimate visual recordings or other material published in circumstances that would breach the Harmful Digital Communications Act 2015, or that would harm the person shown;
  • material that infringes anyone’s copyright, trade mark, privacy, confidence or other rights;
  • anything objectionable under the Films, Videos, and Publications Classification Act 1993, or depicting extreme violence, bestiality, or sexual conduct involving coercion;
  • anything promoting coercion, trafficking, forced labour or exploitation;
  • offers of illegal drugs, unlicensed medicines, weapons or stolen property;
  • material used to commit, assist or hide fraud, scams, extortion, blackmail or money laundering;
  • automated harvesting, scraping, crawling or bulk extraction of content or personal information, or automated access, without our written consent;
  • attempts to defeat, disable or interfere with security features, rate limits, access controls or other protections;
  • viruses, malware or other harmful code;
  • attempts to reach any account, system, network or data you are not entitled to;
  • fake reviews, ratings, comments or testimonials, including paying others to post them;
  • unsolicited commercial electronic messages in breach of the Unsolicited Electronic Messages Act 2007;
  • another person’s identity, photographs or personal information without their consent;
  • anything unlawful, or anything we reasonably consider brings the site into disrepute or exposes us or our users to legal risk.

7. Moderation and removal

We are a directory, not a publisher of last resort, and we do not undertake to review everything before it appears. Even so, we may review, edit, restrict, refuse or remove any listing or content, and suspend or terminate any account, at any time and without notice, where we reasonably consider that:

  • the content breaks these terms or the law;
  • somebody’s safety is at risk;
  • a person under 18 is involved;
  • the content is likely to expose us, our users or anyone else to legal liability;
  • the account has been used for fraud, spam, abuse or other misuse.

We will also remove content in response to a valid legal request, a court order, or a properly substantiated complaint from a rights holder.

Where we suspend or terminate an account for breaching these terms we may block further accounts from the same person and keep the records needed to make that stick — see our Privacy Policy.

We do not promise that anything will be published, will stay published, or will appear within any particular time. Moderation is a judgement call we make, and our failure to remove something is not approval of it.

8. What you are promising us

When you submit a listing you are telling us, and we are relying on it, that:

  • you are 18 or over, and so is everyone depicted, described or referred to in the listing;
  • you have the right to publish the listing and everything in it, including every photograph and every word;
  • you have every consent needed from anyone whose image, name, voice or personal information appears in it;
  • the information is accurate, current and not misleading;
  • it complies with New Zealand law, including the Prostitution Reform Act 2003, the Films, Videos, and Publications Classification Act 1993, the Harmful Digital Communications Act 2015, the Fair Trading Act 1986 and the Privacy Act 2020;
  • it infringes nobody’s intellectual property, privacy or other rights;
  • you will keep to these terms and to any applicable local authority bylaw.

If a listing stops being accurate, fix it or take it down.

9. Paid features

We offer paid placements, featured listings, boosts, credits and subscriptions. What you get, and what it costs, is shown on the site when you buy.

Unless we say otherwise at the time of purchase:

  • you are paying for advertising and site features — never for any service advertised on the site;
  • once a feature has been delivered — a listing published or featured for the agreed period — the fee is not refundable;
  • where we do refund, it is for unauthorised or fraudulent payment, a duplicate payment, or our failure to deliver what was bought;
  • if we remove a listing or close an account because these terms were broken, remaining time, credits or paid features may be forfeited without refund;
  • prices can change, but never for a feature you have already bought.

Nothing in these terms is meant to cut down any right you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded. Where you buy advertising or site features in trade — that is, for business purposes — you and we agree the Consumer Guarantees Act 1993 does not apply, as section 43(2) of that Act allows.

Any tax on your own activities is your responsibility.

10. Our material

The site itself — its software, design, layout, text, graphics, logos, databases and trade marks — belongs to us or is licensed to us, and is protected by the Copyright Act 1994 and other laws. Do not copy, reproduce, adapt, distribute, publicly display or build derivative works from any part of it, except as these terms or the law allow.

Our name, logo and trade marks may not be used without our written consent.

11. Your material and the licence you give us

You keep ownership of what you submit.

By submitting a listing or other content you give us a non-exclusive, worldwide, royalty-free, transferable licence — with the right to sublicense to our service providers — to host, store, reproduce, adapt for technical reasons such as resizing and formatting, publish, display, distribute and communicate your content, for the purposes of running, providing, promoting and improving the site and delivering what you asked for.

That licence ends when you delete the content or your account, with two exceptions: we may keep copies where the law, accounting, security, moderation or backups require it, and content already shared with or cached by third parties, or indexed by search engines, may persist beyond our control.

You confirm you hold every right and permission needed to give us that licence.

12. Copyright and rights complaints

If you believe content on the site infringes your copyright or another right, write to [email protected] with:

  • your name and contact details;
  • what work or right is affected;
  • the exact URL or location of the material complained of;
  • why you say the use infringes;
  • a statement that what you have told us is accurate and that you are the rights holder or authorised to act for them.

We review properly substantiated complaints and may remove or disable access to the material. We may also put the complaint to the advertiser and give them a chance to respond.

13. Other people’s listings

Listings and most content here come from third parties. We do not create, verify, endorse, recommend or guarantee any advertiser, listing or service. A listing appearing on the site is not a recommendation, and does not mean we have checked the advertiser’s identity, age, claims or qualifications beyond any verification badge actually shown.

The site also links to third-party websites. We do not control them and are not responsible for what they contain or do.

14. What we do not promise

To the fullest extent the law allows, and subject to section 15:

  • the site and its content are provided as they are and as available;
  • we do not promise the site will be uninterrupted, secure, error-free or free of harmful code, or that any content is accurate, complete, lawful or fit for any purpose;
  • we are not responsible for how any user or advertiser behaves, online or offline, or for any arrangement anybody enters into as a result of the site;
  • how you deal with advertisers and other users, and how you assess the suitability, legality and safety of any arrangement, is entirely your call.

We do not give legal, medical, financial or safety advice, and nothing here should be read as doing so.

15. Limits on our liability

To the fullest extent New Zealand law allows, we exclude all liability to you for loss or damage arising out of or in connection with your use of the site, including indirect, incidental, special, consequential or punitive damages, and loss of profits, revenue, data, goodwill, opportunity or reputation.

Where our liability cannot lawfully be excluded but can be limited, our total aggregate liability to you is limited to the greater of what you paid us in the 12 months immediately before the event giving rise to the claim, or NZ$100.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including under the Consumer Guarantees Act 1993 where it applies, or for fraud.

16. Your responsibility to us

You agree to indemnify us against any loss, liability, claim, demand, damage, cost or expense (including reasonable legal costs) we incur because of:

  • your breach of these terms or of any law;
  • content you submit, including any claim that it infringes a third party’s rights;
  • your dealings with any advertiser or user;
  • any false or misleading statement you make to us.

This does not apply to the extent the loss was caused or contributed to by our own negligence, wilful misconduct or breach of these terms.

17. Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these terms. By using the site you acknowledge that your personal information will be handled as described there.

18. Reporting something serious

If you find content on the site that involves a minor, involves coercion or trafficking, is otherwise unlawful, or that you believe is harmful, report it at once to [email protected]. Include the URL and as much detail as you can.

Where content appears to involve the sexual exploitation of a minor or other serious offending, we remove it and report it to the New Zealand Police or another appropriate authority.

19. Police and legal requests

We cooperate with law enforcement and regulators as New Zealand law requires. We may disclose information in response to a valid legal request or court order, or where disclosure is necessary to prevent or investigate serious offending or to protect someone from serious harm — as described in our Privacy Policy.

20. Changes to these terms

We may amend these terms. The current version sits on this page with its effective date. Where a change is material we will take reasonable steps to bring it to your attention. Continuing to use the site after the amended terms take effect means you accept them; if you do not, stop using the site.

21. New Zealand law

These terms are governed by New Zealand law, and you and we submit to the non-exclusive jurisdiction of the New Zealand courts for any dispute arising out of or in connection with them or the site. Nothing here stops either side from seeking urgent relief in any court with jurisdiction.

22. The small print

Whole agreement. These terms, our Privacy Policy and any additional terms published on the site are the entire agreement between you and us about the site.

Severability. If a provision is held invalid or unenforceable it is severed, and the rest stays in force.

No waiver. If we do not enforce something, or are slow to, that is not a waiver of it.

Assignment. We may assign or transfer our rights and obligations under these terms. You may not assign yours without our written consent.

Accepting electronically. You agree that you can accept these terms electronically — by clicking to accept, by registering, or simply by continuing to use the site. That satisfies the requirements for electronic transactions under the Contract and Commercial Law Act 2017.
